2.3 We reserve the right to change the Terms and Conditions under which the website and goods are provided. Any such change in Terms and Conditions will be effective to all new orders once published on the website. You must check the Terms and Conditions before you purchase items from the website to ensure that you are aware and comply with the current version.
2.4 If any provision of these Terms and Conditions is held by a court or other competent authority to be invalid or unenforceable, the remainder of these Terms and Conditions shall continue to have full force and effect.

3. Information on the website and goods

3.1 We try to ensure that all information on the website, including description of our goods, photographic representations and listed prices are accurate and correct at all times. However mistakes do happen. We will try to resolve all information errors on the website as soon as reasonable possible and if we reasonable think that such an error has affected your purchase of goods we will try to let you know. Therefore we will not be liable to you for any errors on the website.
3.2 All drawings, specifications, photographs, descriptive matter and advertising published by us or contained on our website are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the terms. We are unable to guarantee that the product images are an accurate representation of the actual merchandise.
3.3 All sizes and measurements are approximate.
3.4 We reserve the right to suspend, restrict or terminate your use of this site at any time.
3.5 We reserve the right to amend, remove or vary any part of this website at any time and without notice.

4. Order Process

4.1 All orders that you place on this website will be subject to acceptance and availability.
4.2 By submitting your order you are offering to purchase goods from us and this does not form a binding contract until accepted by us.
4.3 On receipt of your order, we will send you an order acknowledgement email to the email address that you provide in the order process. This order acknowledgement email will contain your order number, details of the goods ordered and a delivery estimate. This email is not an order confirmation or order acceptance.
4.4 We are not obliged to supply the goods to you until we have confirmed that we have accepted your order and received payment in full. Acceptance of your offer to purchase and the completion of the contract between you and SILKEN ROUTE will take place when your order is dispatched and we send you an order dispatch email. We reserve the right to refuse any offers in an order prior to acceptance and will not be required to provide an explanation.

5. Pricing

5.1 All prices and charges on the website are in GBP, Euros or US Dollars and are inclusive of VAT (where applicable) at the current rate.
5.2 Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm the order at the correct price or cancel it. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.
5.3 Delivery charges will be applied based on the delivery address chosen and added to the price to be paid by you.

6. Delivery Details

6.1 We insure each purchase during the time it is transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient or different delivery address, then you accept that evidence of signature by them (or at that delivery address) is evidence of delivery and fulfillment by us, and transfer responsibility in the same way.
6.2 All orders received before 2:00pm Monday to Friday will usually be dispatched the same day. Orders received after 2:00pm, at the weekend or on public holidays, will be sent out the next working day. If there is a problem with your order that prevents us from dispatching it, for example it is not currently in stock, we will normally contact you within 24 hours of the order being received by us or on the next working day.
6.3 Deliveries are usually made within 3 to 5 working days of dispatch unless your goods are being sent outside the UK. All goods will be delivered by a recorded delivery through a reputable courier service.
6.4 We will make every effort to deliver goods within the estimated timescales. However delays are occasionally inevitable due to unforeseen factors or events outside our control, for example extreme weather, flood or fire. SILKEN ROUTE shall be under no liability for any delay or failure to deliver the goods within the estimated timescales.
6.4 Please note, any delivery estimates given on the website or by email are estimates only.

7. Payment

7.1 Payment can be made securely online by Visa, Visa Electron, Visa Delta, Mastercard, American Express, Maestro and PayPal. You may also place your order by calling our customers care team.
7.2 Payments will be debited and cleared from your account upon dispatch of your order by SILKEN ROUTE. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to SILKEN ROUTE, we will not be liable for any delay or non-delivery. We also reserve the right to cancel your order.
7.3 By submitting an order to us through our website you specifically authorise us to transmit information or to obtain information about you from third parties from time to time, including, but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions. You also represent and warrant that the payment details provided on your order are valid and correct and that when your order is accepted and processed by us, payment will be made in full.
7.4 We take reasonable care to make our Site secure. We use the latest Secure Socket Layer (SSL) encryption technology to store and safely transmit your personal and credit card information through our systems. All transactions are processed through a secure checkout system provided by SagePay. All personal information is strictly confidential.
7.5 Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

9. Cancellation

9.1 If you are a customer based in the EU, you have the right to cancel your order with us under the Consumer Protection (Distance Selling) Regulation 2000 (DSRs).
9.2 To cancel an order you must notify us in writing quoting your order reference number, within 7 working days of receipt. Either email us at customercare@silkenroute.com or write to us at Notice of Contract Cancellation, Customer Care Department, Silken Route Ltd, 2 Trinity Court, 53 Wake Green Road, Birmingham, B13 9HW.
9.3 If you have not yet received your order, please contact customercare@silkenroute.com as soon as possible to arrange a cancellation before the order is dispatched.
9.4 If your order has already been processed and dispatched to you, it will be necessary for you to return the goods following our return policy, detailed above so we can process your refund.
9.5 On receipt of the returned goods, refunds will be credited to the original payment method only. Any additional duties and taxes incurred by customers are non-refundable. Please note you must cover the cost of the return shipment.

10. Overseas order

10.1 We do not charge any customs duties on international shipments. If any additional customs charges are incurred during your shipment, they are not calculated or monitored by us nor are they our responsibility. While we do not expect there to be any additional charges attached to your order, we recommend you check with you local customs officials for more information regarding importation taxes/duties that may be applicable to your online order with us.
10.2 International customers may receive an additional email when we receive the order. This is to confirm the identity and delivery address due to increase security procedures required for overseas transactions. We may require a copy of the credit card used and a copy of a current utility bill or bank statement showing the delivery address.

11. Registration

11.1 Registering and using the website may involve setting up an account and providing a password. When you register you are required to provide information about yourself that is true, accurate, current and complete.
11.2 You are responsible for maintaining the confidentiality of your account and the password and must notify us immediately of any breach of security or unauthorised use of your account.
